Confirmation of Amy Coney Barrett Puts Reproductive Health & Rights at Risk
Voters have already cast millions of ballots to ensure this is Trump’s last SCOTUS appointment 

Washington, DC — Today, Sens. Martha McSally (R-AZ), Thom Tillis (R-NC), Cory Gardner (R-CO) Joni Ernst (R-IA), John Cornyn (R-TX), Steve Daines (R-MT) and more helped seal their political fate by voting to confirm Trump’s third nominee to the Supreme Court, ignoring the will of the voters and putting access to essential health care, rights, and freedoms at risk.

Even though Barrett refused to answer questions related to the constitutional right to use birth control or access abortion during her confirmation hearings, we know Trump vowed to nominate Supreme Court Justices who would overturn Roe v. Wade and “do the right thing" by striking down the Affordable Care Act. During the 2016 election, he announced his litmus test when he stated: “If we put another two or perhaps three justices on...[overturning Roe] will happen. And that’ll happen automatically, in my opinion, because I am putting pro-life justices on the court.” And just this week, Trump told 60 Minutes, when asked about the ACA: “I hope they end it.” Barrett’s record makes it clear why she passes his litmus test.

“The senators who supported Trump and rushed through a nominee, days before an election, should prepare to lose their jobs. Rather than focus on desperately needed COVID-19 relief, in a blatant power grab, Trump and senators like Cory Gardner, Joni Ernst, and Martha McSally made it a priority to do the bidding of their party instead of their constituents. Now, they’ve put another justice on the Court who is expected to vote to eliminate access to health care for tens of millions of people and further restrict reproductive rights. In just 8 days, voters will hold them accountable. Planned Parenthood Votes will help ensure this is the last Supreme Court confirmation vote they take in office.”

Today’s confirmation vote, and the threat Barrett poses to health care access and reproductive rights, put vulnerable Senators in direct conflict with voters. Polling consistently shows that voters want the Senate focused on COVID-19 relief, not a rushed Court nomination. Support for the ACA is at record highs, and 77% of the country is in favor of  protections guaranteed by Roe v. Wade. All of this and more is at risk with Barrett on the court.

Earlier this year, the Supreme Court came one vote short of opening the floodgates to an onslaught of restrictions that would make safe, legal abortion in the United States a right in name only. Justices Brett Kavanaugh and Neil Gorsuch would have upheld Louisiana's medically unnecessary abortion restriction — just as Donald Trump hoped when he pledged to only appoint U.S. Supreme Court justices who would overturn Roe v. Wade. Now, 17 abortion-related cases are just one step from the Supreme Court. Today’s vote to confirm Trump’s third nominee  could be the tipping point that secures a Court hostile to reproductive and civil rights for a generation.

Access to abortion is hanging on by a thread across the country, and for too many people — specifically Black and Brown communities forced to navigate a legacy of systemic racism and discriminatory policies — Roe is essentially meaningless because abortion is already inaccessible.
