Check out the status of abortion care, gender-affirming health care, and many other issues that we're following.
Abortion is available through 26 weeks and 6 days of pregnancy in Virginia.
As of May 2025, abortion remains legal and accessible in Virginia. It is the only state in the South without a post-Roe abortion ban. You can access an abortion in Virginia up to 26 weeks and 6 days.
In 2020, Virginia repealed several medically unnecessary restrictions on abortion access, such as mandatory ultrasounds and waiting periods, enhancing reproductive healthcare availability. If you are under 18, you are still required to obtain parental consent to have an abortion. However, you can seek a judicial bypass, allowing a judge to authorize the abortion without parental consent or notification.
Additionally, Virginia has enacted protections against extradition for people facing out-of-state charges related to reproductive health care that is legal within the Commonwealth.
Gender-affirming health care for trans youth is legal in Virginia.
Currently, there is no state law in Virginia explicitly banning gender-affirming care for minors. If you are under 18, you can start care with consent from your parental or legal guardian.
