WHY THIS AMENDMENT MATTERS

  • The amendment will protect the right to abortion, birth control, miscarriage management, IVF, and the full scope of reproductive health care in Virginia, no matter who’s in office.

  • Politicians shouldn’t interfere in personal medical decisions. 
  • Protects health care professionals so that they won’t have to risk jail time just to treat the patient in front of them. 
  • Keeps patients – not politicians – in charge of their own health care decisions, so that people can make these personal decisions.
  • A majority of Virginians support reproductive freedom.

  • 2025 Session: First Legislative Passage (DONE!)
  • 2025 Election: Must Maintain Pro-Reproductive Freedom Majority
  • 2026 Session: Second Legislative Passage Required
  • 2026 Election: Virginians Vote to Approve the Amendment
  • Beyond 2026: Amendment Enshrined in the VA Constitution 

Note: The Constitutional Amendment must pass in two consecutive sessions with an intervening election in order to move forward and be placed on the 2026 general election ballot. Assuming a pro-reproductive freedom majority is maintained as a result of the 2025 election, there will also be a bill, known as enabling legislation, to authorize the referendum being placed on the ballot. This is a procedural measure. The Governor cannot veto the amendment, but does have a procedural role in 2026 to sign the enabling legislation.

Virginians for Reproductive Freedom

PPAV has joined over a dozen partners in forming Virginians for Reproductive Freedom, a coalition of advocacy organizations who believe that all Virginians should be able to make decisions regarding their own reproductive health care, including abortion care, without government interference, and no one should be faced with criminal punishment for making these decisions or providing healthcare.
