South Carolina Legislative Updates
The second year of South Carolina's two-year session ended on May 12, 2022. Here, you will find information on bills that we were following and where they ended up.
Senate Bill 628 – Birth Control Access
This bill would expand access to the pill by eliminating the need for all patients to first get a prescription from a doctor before going to have it filled at a pharmacy, making it easier for folks to get the birth control method of their choice. This would especially help people who live in rural areas or otherwise do not have immediate access to a physician.
Last action: Signed into law on 5/18/22.
Senate Bill 907 – Medical Abortion Misinformation
This bill would force providers to give patients misinformation about medication abortion that is medically inaccurate and could put their life in danger. The bill claims that a patient’s decision to end a pregnancy can be undone when no credible evidence or medical research supports that claim. A companion bill, House Bill 4568, was introduced in the House.
Last action: Sent to full Senate
This bill did not become law.
Senate Bill 1127 – Trigger Ban (formerly Senate Bill 988)
A so-called “trigger ban.” This is a total ban on abortion that would immediately go into effect if (read: when) the Supreme Court dismantles Roe v. Wade. It could make abortion a crime not only for medical professionals providing this care but also for anyone seeking an abortion. Anyone who violates this law could be charged with murder and face the death penalty.
Last action: Passed Senate Medical Affairs Subcommittee on 1/26/2022; Sent to full Medical Affairs Committee
This bill did not become law.
Senate Bill 1130: Health Care Refusal
This bill allows providers to deny health care to anyone for any reason. If passed, South Carolinians could be denied birth control, gender-affirming care, and more based on the provider’s moral or religious beliefs.
Last action: Sent to Senate Medical Affairs Subcommittee
This bill did not become law.
House Bill 4776: Health Care Refusal
This bill allows providers to deny health care to anyone for any reason. If passed, South Carolinians could be denied birth control, gender-affirming care, and more based on the provider’s moral or religious beliefs.
Last action: Sent to conference (House did not concur with amendments passed by Senate)
This bill did not become law.
House Bill 4608 – Anti-Trans Discrimination
Every student should be able to access the opportunities and lessons of school athletics. To categorically deny transgender students the freedom to play alongside their peers is completely at odds with lawmakers’ duties to care for and protect our youth.
Last action: Sign into law on 5/16/22.
